मुख्य दिक्कतें ये हैं कि नए दिशानिर्देश ‘भुगतान और स्वीकृति’ योजना में तब्दील हो जा सकते हैं और सीडीएससीओ की पारदर्शिता भी एक समस्या है। कंपनियां अभियोजन से “पहले या बाद में” सुलह की मांग कर सकती हैं। हालांकि अगर सीडीएससीओ सुलभ संबंधी आदेश (संपादित ही सही) और मामले का ब्योरा प्रकाशित नहीं करता है, तो जनता का कानूनी कार्रवाई और नियामक पर से भरोसा उठ सकता है। भले ही बार-बार अपराध करने वालों को यह सहूलियत न मिले, लेकिन सार्वजनिक रूप से जांच-परख करने की एक व्यवस्था जरूरी है। मार्गदर्शन में विवेक और शर्तों पर जोर उस सार्वजनिक रिपोर्टिंग की जगह नहीं ले सकता, जिससे निष्पक्ष लोग यह जांच कर सकें कि वही कंपनियां बार-बार गलती तो नहीं कर रही हैं। इसी तरह, प्रकाशित प्रक्रिया में उपभोक्ता समूहों या मुखबिरों (व्हिसल-ब्लोअर) को मुक्ति दिए जाने से पहले अपनी बात रखने का मौका नहीं मिलता है। इसके बाद, माफ की जा सकने वाली गलतियों के बारे में जिस तरह से लिखा गया है, वह असल में काफी व्यापक है और इसमें कागजी कार्रवाई में गलतियों से लेकर अनुपालन संबंधी बेहद गंभीर नाकामी तक, कई तरह के व्यवहार शामिल किए गए हैं। अगर माफी के जुर्माने भी बहुत कम रखे जाते हैं, उन्हें ठीक से लागू नहीं किया जाता है या रोकने के बजाय रूटीन के तौर पर इस्तेमाल किया जाता है, तो अनुपालन में कमी आनी ही है। शायद सबसे जरूरी बात यह है कि सीडीएससीओ को माफी को सुधारात्मक व निवारक कार्रवाइयों, फॉलो-अप मुआयना और जरूरी होने पर अलर्ट जारी करने या कंपनियों को उत्पाद वापस मंगाने का निर्देश देने जैसी सार्वजनिक रूप से की जाने वाली कार्रवाइयों से भी जोड़ना चाहिए। नहीं तो, वक्त के साथ जोखिम में स्थायी कमी नहीं आ पाएगी।
